PoliticalWin Platform Terms of Service

PoliticalWin provides campaign website software. Campaigns control their own public content, legal review, disclaimers, donation links, and published statements.

PoliticalWin provides campaign website software and related tools. PoliticalWin does not provide legal, campaign-finance, tax, accounting, cybersecurity, election-law, advertising, or political strategy advice.

1. Agreement to these Terms

These Terms govern access to and use of PoliticalWin, including PoliticalWin.com, customer dashboards, campaign website templates, media tools, forms, translation tools, custom-domain tools, support tickets, documentation, and related services. By creating an account, selecting a plan, using the dashboard, publishing a campaign website, or otherwise using PoliticalWin, you agree to these Terms on behalf of yourself and, if applicable, the campaign, committee, organization, candidate, officeholder, or entity you represent.

If you do not agree to these Terms, do not use PoliticalWin.

2. PoliticalWin's role

PoliticalWin is a self-serve software platform for creating and managing campaign websites. PoliticalWin is not a campaign, political committee, fundraising committee, treasurer, compliance consultant, legal representative, agent, employer, partner, joint venturer, publisher of campaign speech, or representative of any candidate or campaign.

PoliticalWin does not endorse, sponsor, oppose, support, approve, or represent any candidate, campaign, party, committee, officeholder, ballot measure, issue committee, advertiser, donor, volunteer, endorsement source, or public statement appearing on a customer website. Customer campaign websites are customer-controlled websites rendered through PoliticalWin software.

3. Customer responsibility for campaign content

You are solely responsible for all content, media, links, forms, disclaimers, claims, statements, endorsements, testimonials, event information, donation links, translations, domain settings, privacy notices, and legal text that you create, upload, publish, import, approve, or display through PoliticalWin.

This responsibility includes, without limitation:

- Candidate biographies, slogans, issues, policy statements, event descriptions, news posts, endorsements, testimonials, press materials, FAQs, media kits, and public contact details.
- Photos, logos, videos, documents, captions, image alt text, and other media.
- Paid-for-by, authorized-by, treasurer, committee address, privacy, terms, and other disclaimer or compliance-related fields.
- External donation links and any language around contributions, eligibility, limits, refunds, or donor requirements.
- English, Spanish, and bilingual content, including AI-assisted translation drafts and manual edits.
- Domain names, DNS settings, SSL/TLS readiness, and public URL choices.

PoliticalWin may provide field labels, helper notes, starter templates, legal-language fields, SEO previews, quality checks, and automation tools, but those tools do not make your website legally compliant and do not replace review by qualified counsel or other professional advisors.

4. No legal or campaign-finance advice

PoliticalWin provides compliance-friendly fields and disclaimer fields, not legal guarantees. You are responsible for determining what laws, rules, regulations, platform policies, campaign-finance rules, election rules, disclosure rules, privacy rules, advertising rules, accessibility requirements, records-retention requirements, and donor-related rules apply to your campaign or organization.

PoliticalWin does not review your website for legal compliance. PoliticalWin does not guarantee that any template, disclaimer field, donation-link button, privacy template, terms template, SEO structure, translation, form, or support response satisfies federal, state, local, platform, party, committee, or election-authority requirements.

5. External donation links only

PoliticalWin does not process campaign donations or contributions. Donation buttons and contribution calls to action link to external websites or contribution platforms selected by the customer, such as ActBlue, WinRed, Anedot, RaiseTheMoney, Stripe, or another provider.

You are solely responsible for choosing, configuring, reviewing, and monitoring any external donation or contribution platform, and for ensuring that all donation pages, contribution language, donor eligibility rules, disclaimers, reporting, refunds, and compliance obligations are handled correctly.

6. Prohibited content and conduct

You may not use PoliticalWin for illegal, harmful, abusive, immoral, deceptive, unethical, or platform-damaging activity. The following list is not exhaustive. PoliticalWin may suspend, restrict, remove, archive, disable, or terminate service for any activity PoliticalWin reasonably believes violates these Terms, applicable law, third-party rights, platform integrity, public safety, or the trust and safety of PoliticalWin, its customers, or the public.

Prohibited activity includes, without limitation:

- Illegal activity, unlawful fundraising, unlawful campaign activity, unlawful coordination, or activity that appears designed to evade campaign-finance, election, tax, privacy, or consumer-protection rules.
- Fraud, scams, impersonation, identity theft, deceptive fundraising, fake campaigns, fake candidates, fake committees, fake endorsements, fake testimonials, fake donor claims, fake customer claims, or misleading statements about affiliation, authorization, sponsorship, support, or approval.
- Defamation, libel, slander, threats, harassment, stalking, doxxing, intimidation, extortion, blackmail, non-consensual publication of private information, or content that targets people for abuse.
- Hateful, violent, abusive, or dehumanizing content directed at protected classes or vulnerable people, or content that encourages unlawful discrimination, violence, or harassment.
- Content encouraging, organizing, threatening, praising, or facilitating violence, terrorism, extremist violence, physical harm, property destruction, or unlawful intimidation.
- Sexually exploitative content, non-consensual intimate imagery, child sexual abuse material, trafficking-related content, or any content involving exploitation of minors.
- Malware, phishing, credential theft, unauthorized access, spam, bot activity, scraping, attempted platform abuse, security probing, or interference with PoliticalWin systems or other customers.
- Uploading executable files, malicious files, illegal files, stolen files, private data without permission, voter data obtained or used unlawfully, or materials that violate confidentiality or data-protection duties.
- Copyright, trademark, publicity-rights, privacy-rights, or other intellectual-property violations, including campaign logos, photos, music, videos, endorsements, or third-party media used without permission.
- False, misleading, or unsupported claims about PoliticalWin, election officials, voting processes, endorsements, campaign status, donation processing, legal compliance, public agencies, or third-party services.
- Publishing content that PoliticalWin reasonably believes may expose PoliticalWin, infrastructure providers, payment providers, email providers, DNS providers, hosting providers, or other customers to legal, security, operational, reputational, or trust-and-safety risk.

PoliticalWin may act on customer reports, public reports, staff review, provider reports, law-enforcement requests, court orders, legal notices, automated safeguards, or other information available to PoliticalWin.

7. Suspension, removal, cancellation, and emergency action

PoliticalWin may suspend, restrict, unpublish, archive, remove, disable, or terminate any account, campaign website, custom domain, media asset, form, support attachment, translation, or content if PoliticalWin reasonably believes the account or content violates these Terms, creates risk, harms users, interferes with service operation, violates a third-party provider rule, or may be unlawful.

PoliticalWin may take emergency action without advance notice when needed to protect people, customers, third parties, platform security, service availability, legal obligations, payment or infrastructure providers, or the public. PoliticalWin may preserve records where legally required or operationally necessary.

8. Account access and authorized users

You are responsible for safeguarding account credentials, choosing appropriate user roles, removing users who should no longer have access, and monitoring account activity. You are responsible for actions taken through your account or by users you invite, unless caused by PoliticalWin's proven unauthorized system access.

End users may not access Django admin or staff-only systems. Staff and superuser access is reserved for authorized PoliticalWin personnel or platform operators.

9. Plans, billing, cancellation, and plan changes

PoliticalWin plan pricing, billing intervals, Stripe price IDs, subscription status, cancellation, scheduled plan changes, officeholder mode, archive mode, and annual-plan settings are managed through the dashboard, Stripe, and platform configuration.

Unless otherwise stated in a written agreement, paid plans are billed through Stripe. PoliticalWin may use Stripe Checkout, Stripe Billing, Stripe customer portals, webhooks, subscription schedules, or scheduled plan-change processing. You must keep payment information current. If payment fails, access may be limited, public websites may be unpublished or paused, and custom-domain service may be affected.

10. Archive mode and officeholder mode

Archive mode is intended to store campaign content and media at a lower monthly price while the public website is offline or shows a paused/archive page. Archive sites should generally be noindex unless explicitly configured otherwise.

Officeholder mode is intended for candidates who win and want to shift a website toward public official or officeholder positioning. Availability windows and staff overrides may apply. You remain responsible for ensuring that post-election content, disclaimers, public-office language, and any official-capacity restrictions are legally appropriate.

11. Custom domains, DNS, and SSL

PoliticalWin may provide custom-domain tools, DNS instructions, TXT verification tokens, CNAME/A/nameserver guidance, SSL status fields, and dedicated-server deployment guidance. Domain registrars, DNS providers, Caddy, Nginx, Certbot, certificate authorities, hosting providers, and email providers are third-party systems.

You are responsible for entering accurate domains, verifying ownership, understanding DNS changes, preserving email and other domain services, and ensuring that your custom domain does not infringe third-party rights or violate law. PoliticalWin is not responsible for registrar outages, DNS propagation delays, misconfigured nameservers, email disruption caused by DNS changes, certificate delays, third-party provider failures, or browser warnings caused by incomplete SSL setup.

12. Forms, personal information, and exports

PoliticalWin may collect and store form submissions for contact, volunteer, signup, yard sign, event RSVP, support, and related workflows. You are responsible for how your campaign collects, uses, exports, shares, retains, protects, and deletes personal information collected through your public campaign website.

Campaigns are responsible for their own public website privacy notices, consent language, data exports, supporter lists, volunteer lists, RSVP records, and any use of information collected through forms.

You must not use PoliticalWin to collect sensitive personal information unless you have a lawful basis and appropriate safeguards. You must not upload or export data in a way that violates privacy, election, consumer-protection, data-security, or other applicable laws.

13. AI-assisted translation

PoliticalWin may provide AI-assisted English-to-Spanish translation scaffolding or integration. AI translations are convenience drafts. You are responsible for reviewing, correcting, approving, and publishing translated content. Legal disclaimers, donation language, candidate names, office names, district names, slogans, URLs, and glossary terms require special care. PoliticalWin does not guarantee translation accuracy or legal sufficiency.

14. Intellectual property and permissions

PoliticalWin owns or licenses the PoliticalWin software, templates, documentation, designs, code, platform branding, and service infrastructure. Customers retain responsibility for campaign content they upload or create. By uploading content, you represent that you have all rights, permissions, licenses, releases, and consents needed to use and publish that content through PoliticalWin.

PoliticalWin may remove or disable content that is alleged to infringe copyright, trademark, publicity, privacy, or other rights. PoliticalWin may provide a copyright or abuse-report process, but those processes do not replace legal remedies.

15. Testimonials, endorsements, and public claims

You may not publish fake testimonials, fake endorsements, fake organizations, fake customer examples, fake logos, fake statistics, fake approvals, or claims that imply consent, endorsement, affiliation, or authorization you do not have. If you publish endorsements, testimonials, or third-party logos, you are responsible for permission, accuracy, and required disclosures.

16. Email, notices, and support

PoliticalWin may send service emails, billing notices, support notifications, security notices, form-submission notifications, and account-related messages. Support tickets are the preferred way to request help because they preserve category, priority, replies, attachments, and status. Email notifications may be scaffolded or depend on production email configuration.

17. Service changes and availability

PoliticalWin may modify, add, remove, limit, suspend, or discontinue features, templates, plans, integrations, or workflows. PoliticalWin aims to keep published websites available, but does not guarantee uninterrupted or error-free service. Planned maintenance, emergency maintenance, provider outages, security events, DNS issues, customer configuration errors, and force majeure events may affect availability.

18. Disclaimers

PoliticalWin is provided on an "as is" and "as available" basis to the maximum extent permitted by law. PoliticalWin disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, legal compliance, campaign success, fundraising performance, search-engine rankings, translation accuracy, domain availability, DNS propagation, SSL issuance, or suitability for any specific election, jurisdiction, candidate, committee, office, party, or campaign.

19. Limitation of liability

To the maximum extent permitted by law, PoliticalWin and its owners, operators, employees, contractors, vendors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages; lost donations; lost votes; lost campaign opportunities; reputational harm; data loss; downtime; domain misconfiguration; provider outages; legal noncompliance; third-party claims; or customer content, even if advised of the possibility of such damages.

Any monetary liability should be limited to the amount paid to PoliticalWin for the affected service during the period defined by counsel in the final production terms, except where a different limitation is prohibited by law.

20. Indemnification

You agree to defend, indemnify, and hold harmless PoliticalWin and its owners, operators, employees, contractors, vendors, and affiliates from claims, demands, liabilities, losses, damages, costs, and expenses, including reasonable attorneys' fees, arising from or related to your account, campaign website, content, media, domains, donation links, forms, exports, translations, endorsements, disclaimers, legal compliance, violation of these Terms, violation of law, or infringement of third-party rights.

21. Updates to these Terms

PoliticalWin may update these Terms from time to time. When a new active version is published, dashboard users may be required to review and accept the current version before continuing. Continued use of PoliticalWin after updated Terms become effective means you accept the updated Terms.

22. Governing law and disputes

These Terms are governed by applicable law to the maximum extent permitted. Any dispute, claim, or controversy related to PoliticalWin, these Terms, customer accounts, published campaign websites, billing, content, domains, forms, support, or platform access must be handled in an appropriate court or forum with authority over the dispute. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law.

23. Contact and abuse reports

Questions, support requests, abuse reports, copyright concerns, impersonation reports, security concerns, or unlawful-content reports should be submitted through the PoliticalWin contact, support, or abuse-report process. PoliticalWin may request additional information before taking action.
